Terms of Use

1. Introduction and Acceptance

Welcome to FixNow (“the Platform”, “we”, “us”, or “our”), a cloud-based workshop management and customer relationship management (CRM) service operated by FixNow (“FixNow”, a business based in Malaysia).

These Terms of Use (“Terms”) constitute a legally binding agreement between you — whether as an individual user, a workshop owner, an employee, or any person accessing the Platform (“User”, “you”, or “your”) — and FixNow. By registering for, accessing, or using the FixNow Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must immediately cease using the Platform and close your account.

These Terms are governed by and construed in accordance with the laws of Malaysia, including but not limited to the Personal Data Protection Act 2010 (PDPA), the Communications and Multimedia Act 1998, the Computer Crimes Act 1997, and the Electronic Commerce Act 2006.

2. Description of the Platform

FixNow is a Software-as-a-Service (SaaS) platform designed specifically for small and medium-sized automotive workshops, tyre shops, garages, mobile mechanics, and related vehicle service businesses in Malaysia and Southeast Asia. The Platform provides:

  • Customer relationship management (CRM) tools for managing workshop clients
  • Vehicle registration and service history tracking
  • Service record creation, editing, and archiving
  • Appointment scheduling and reminder management
  • Invoice generation and billing management
  • Workshop settings and team management
  • Dashboard analytics and operational reporting
  • Notification and reminder tools (including future WhatsApp integration)

The Platform is provided on a multi-tenant basis. Each registered workshop operates within an isolated workspace (“Workshop Account”) where its data is logically separated from all other workshop accounts.

3. Eligibility and Registration

3.1 Eligibility. To use FixNow, you must:

  • Be at least 18 years of age;
  • Have the legal capacity to enter into binding agreements under Malaysian law;
  • Operate or be authorised to represent a legitimate automotive workshop or related business; and
  • Provide accurate, complete, and current information during registration.

3.2 Account Registration. You must create an account to access the Platform. You agree to provide truthful and accurate information and to keep your account details up to date.

3.3 Account Security. You are solely responsible for maintaining the confidentiality of your login credentials. You must immediately notify us at support@fixnow.my if you suspect any unauthorised access.

3.4 Business Representation. If you register on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms.

4. Subscription Plans and Payment

4.1 Plans. FixNow offers tiered subscription plans, including a free Starter plan and a paid Pro plan.

4.2 Free Trial. Where a free trial is offered, no payment information is required to begin. At the end of the trial period, continued access requires selection of a paid plan.

4.3 Billing. Paid subscriptions are billed in advance on a monthly or annual basis in Malaysian Ringgit (MYR). All fees are exclusive of applicable taxes including Sales and Service Tax (SST) where applicable.

4.4 Refunds. Subscription fees are non-refundable except where required by Malaysian consumer protection law. If you believe you have been charged in error, contact us within 14 days.

4.5 Price Changes. We reserve the right to change subscription pricing with at least 30 days’ written notice to your registered email address.

5. Permitted and Prohibited Use

5.1 Permitted Use. You may use the Platform solely for your legitimate workshop business operations in accordance with these Terms.

5.2 Prohibited Use. You must not:

  • Use the Platform for any unlawful purpose or in violation of any Malaysian or applicable law;
  • Attempt to gain unauthorised access to other workshop accounts or FixNow systems;
  • Reverse engineer, decompile, or attempt to extract the source code of the Platform;
  • Use automated scripts, bots, or scrapers to access the Platform without written consent;
  • Resell, sublicense, or commercialise access to the Platform without written authorisation;
  • Upload malicious code, viruses, or any software intended to damage or impair systems.

6. Data Ownership and Responsibilities

6.1 Your Data. All customer records, vehicle data, service records, and business information you enter into the Platform remain your property. FixNow does not claim ownership of Workshop Data.

6.2 Your Responsibility as Data Controller. Under the PDPA 2010, you are the data controller for all personal data of your customers and employees that you input into FixNow.

6.3 FixNow’s Role as Data Processor. FixNow processes Workshop Data solely on your instructions for the purpose of providing the Platform services.

6.4 Data Portability. Upon request, we will provide you with a copy of your Workshop Data in a machine-readable format within 30 days.

6.5 Data Deletion. Upon termination of your account, Workshop Data will be retained for 90 days to allow for recovery, after which it will be permanently deleted from active systems.

7. Intellectual Property

7.1 FixNow IP. The Platform, including its software, design, interface, branding, logos, trademarks, and all associated intellectual property rights, are owned by or licensed to FixNow.

7.2 Licence to You. Subject to your compliance with these Terms and payment of applicable fees, FixNow grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your internal business operations.

7.3 Feedback. If you submit suggestions, ideas, or feedback about the Platform, you grant FixNow a perpetual, royalty-free, worldwide licence to use and incorporate such feedback without obligation to you.

8. Service Availability and Maintenance

8.1 Uptime. FixNow targets a monthly uptime of 99.5% for the Platform, excluding scheduled maintenance windows. We will provide at least 48 hours’ advance notice for planned maintenance.

8.2 No Guarantee. We do not guarantee that the Platform will be uninterrupted, error-free, or completely secure. The Platform is provided “as is” and “as available”.

8.3 Modifications. FixNow reserves the right to modify, suspend, or discontinue any feature or the Platform as a whole, with reasonable notice where practicable.

9. Disclaimer of Warranties

To the maximum extent permitted under Malaysian law, FixNow expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

10.1 Cap on Liability. To the maximum extent permitted by Malaysian law, FixNow’s total aggregate liability shall not exceed the total fees paid by you in the 3 months immediately preceding the event giving rise to the claim, or RM 500, whichever is greater.

10.2 Excluded Losses. FixNow shall not be liable for any indirect, incidental, consequential, or punitive damages; loss of profits, revenue, customers, goodwill; or loss of data.

10.3 Force Majeure. FixNow is not liable for any delay or failure to perform obligations caused by events beyond our reasonable control.

11. Indemnification

You agree to indemnify, defend, and hold harmless FixNow and its officers, employees, partners, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Platform in violation of these Terms, your violation of any applicable law, or your failure to obtain proper consent from your customers for data processing.

12. Termination

12.1 Termination by You. You may terminate your account at any time by contacting us at support@fixnow.my or through the account settings.

12.2 Termination by FixNow. FixNow may suspend or terminate your account immediately and without prior notice if you breach any material provision of these Terms or your account is used for fraudulent or illegal activities.

12.3 Effect of Termination. Upon termination, your licence to use the Platform ceases immediately.

13. Governing Law and Dispute Resolution

13.1 Governing Law. These Terms are governed by the laws of Malaysia. The courts of Malaysia shall have exclusive jurisdiction.

13.2 Informal Resolution. Before initiating formal proceedings, you agree to first contact FixNow at support@fixnow.my to attempt to resolve the dispute informally.

13.3 Mediation. If informal resolution fails, either party may refer the dispute to mediation through the Malaysian Mediation Centre (MMC).

14. General Provisions

14.1 Entire Agreement. These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and FixNow regarding the Platform.

14.2 Amendments. FixNow may amend these Terms at any time. We will provide at least 14 days’ notice via email or in-Platform notification before material changes take effect.

14.3 Severability. If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary.

14.4 Waiver. Failure by FixNow to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.

14.5 Assignment. You may not assign or transfer your rights or obligations under these Terms without FixNow’s prior written consent.

14.6 Language. These Terms are written in English. In the event of any inconsistency between an English version and any translation, the English version shall prevail.
